What is the Spanish Tax Form 720?

Everyone who is resident in Spain, holding properties or interests located abroad of a value exceeding €50,000, must submit the form 720. Failure to comply with this obligation to pay correctly or on time gives rise to serious fines and penalties – anywhere between 100 and 10,000 euros.

What has the Court Ruled?

The European Commission opened a court case against Spain in relation to Spanish tax form 720, because the Spanish government-imposed fines of up to 150% for failing to file the Form 720. The court ruled that the fines for not complying with the 720 tax form is a “disproportionate penalty”.  This ruling opens a possibility for taxpayers who have been sanctioned for not complying with their obligations regarding the tax form 720 can file claims for a refund.
